Our home is in my wife’s son’s name but she pays the mortgage; if I am made bankrupt can the receiver take the house?
You didn’t mention whether the house was ever in your wife’s / joint names or if it was always in your wife’s son’s name. If it was always in the son’s name, there will be no issue as the payments your wife are making could be for rent. However, it would be a different matter if the house was previously in her name or jointly owned with you, especially if there is equity in the property.
